By booking and using the Gym Hire - P/T facilities at Y-curate (“Y-curate”, “we”, “our”, or “us”) for professional coaching, training, or fitness services, you agree to the following Terms & Conditions. 

These Terms apply to all professional and commercial users including, but not limited to: 

• Personal Trainers (PTs) 

• Strength & Conditioning Coaches 

• Fitness Coaches 

• Mobility Coaches 

• Yoga, Pilates, Barre or Movement Instructors 

• Rehabilitation or Performance Practitioners using the facility commercially 

1. Professional Status & Eligibility 

1.1 By booking and using the Gym Hire - P/T, you confirm that you: 

• hold appropriate qualifications, certifications, and registrations relevant to the services you provide; 

• are legally permitted to provide such services; 

• maintain valid and current professional indemnity insurance and public liability insurance; and 

• will provide evidence of qualifications or insurance upon request by Y-curate. 

1.2 Professional users are solely responsible for ensuring that their qualifications and insurance remain valid and up to date throughout their use of the facility. 

1.3 Y-curate reserves the right to suspend or terminate access where adequate qualifications or insurance are not maintained. 

2. Independent Contractor Relationship 

2.1 Professional users operate as independent businesses and not as employees, agents, representatives, or partners of Y-curate. 

2.2 Nothing in these Terms creates any employment, agency, partnership, or joint venture relationship between Y-curate and the professional user. 

2.3 Professional users must not represent themselves as employees or representatives of Y-curate unless expressly authorised in writing. 

3. Bookings & Payments 

3.1 Gym Hire - P/T sessions must be booked in advance through the Y-curate booking platform. 

3.2 Bookings are subject to availability and confirmed only upon receipt of payment. 

3.3 Session packages and credits must be used within the applicable validity period stated at purchase. 

3.4 Unused sessions that expire are non-refundable and non-transferable unless otherwise agreed in writing. 

3.5 Bookings may be rescheduled up to 24 hours before the scheduled start time. 

3.6 Cancellations, refunds, or credits are not available within 24 hours of the booking start time. 

3.7 Y-curate reserves the right to amend or cancel bookings where reasonably necessary for operational, maintenance, security, or safety reasons. 

4. Access & Security 

4.1 The facility operates on a self-service basis and may be accessed without staff supervision. 

4.2 Access instructions and entry codes will be provided before the booking. 

4.3 Access codes are confidential and must not be shared with unauthorised persons. 

4.4 Gym Hire - P/T users are responsible for all individuals entering the premises under their booking, including clients, assistants, or guests. 

4.5 Gym Hire - P/T users must ensure that all clients behave safely and comply with these Terms while onsite. 

4.6 Users may only access the premises during their booked session times. 

4.7 If you are the final person leaving the premises, you are responsible for ensuring the building is properly secured in accordance with the closing instructions provided. 

5. Client Responsibility & Supervision 

5.1 Gym Hire - P/T are fully responsible for: 

• the supervision of their clients; 

• exercise programming and instruction; 

• client safety and wellbeing; 

• suitability of exercises performed; 

• and all services delivered within the facility. 

5.2 Gym Hire - P/T users must conduct appropriate health screening, informed consent, and risk assessment procedures with their clients where applicable. 

5.3 Gym Hire - P/T users acknowledge that Y-curate does not supervise, endorse, assess, or take responsibility for services provided by independent coaches or trainers. 

5.4 Gym Hire - P/T users must not permit unsafe, reckless, abusive, or inappropriate conduct within the facility. 

6. Use of Equipment & Facilities 

6.1 All equipment must be used safely, responsibly, and only for its intended purpose. 

6.2 Gym Hire - P/T users are responsible for ensuring that clients are instructed in the safe use of equipment. 

6.3 Any damaged, unsafe, or faulty equipment must not be used and must be reported immediately to . 

6.4 Equipment, weights, mats, and accessories must be returned to their designated places after use. 

6.5 The facility must be left clean, tidy, and in substantially the same condition in which it was found. 

6.6 Excessive noise, misuse of equipment, or conduct likely to disturb neighbouring occupiers is prohibited. 

7. Health, Safety & Conduct 

7.1 Gym Hire - P/T users must comply with all health and safety procedures, emergency instructions, and operational guidance provided by Y-curate. 

7.2 Smoking, vaping, illegal substances, and excessive alcohol consumption are prohibited within the premises. 

7.3 Gym Hire - P/T users must not train clients while under the influence of alcohol, illegal substances, or any condition that may impair judgement or safe practice. 

7.4 Any accident, injury, incident, safeguarding concern, or security issue must be reported to Y-curate as soon as reasonably practicable. 

8. CCTV & Privacy 

8.1 CCTV operates within parts of the premises for safety, security, and incident investigation purposes. 

8.2 By entering and using the facility, Gym Hire - P/T users and their clients acknowledge and consent to CCTV recording in accordance with applicable data protection laws and the Y-curate Privacy Policy. 

8.3 Gym Hire - P/T users are responsible for ensuring that their clients are informed that CCTV may be in operation onsite. 

9. Damage, Loss & Liability 

9.1 Gym Hire - P/T users are responsible for any damage caused to the premises, facilities, or equipment by themselves, their clients, assistants, or guests. 

9.2 Any damage, maintenance issue, or incident must be reported immediately to . 

9.3 Y-curate reserves the right to recover reasonable costs associated with: 

• repairs; 

• replacement of equipment; 

• additional cleaning; 

• security callouts; or 

• damage caused through misuse or breach of these Terms. 

9.4 Gym Hire - P/T users accept full responsibility for the professional services they provide and for all interactions with their clients. 

9.5 Y-curate accepts no responsibility for: 

• injuries arising from coaching activities or exercise instruction; 

• professional advice provided by users; 

• loss, theft, or damage to personal belongings; 

• unsupervised activities; or 

• interruptions caused by circumstances outside our reasonable control. 

9.6 Nothing in these Terms excludes or limits liability where such exclusion is prohibited by law. 

10. Suspension & Termination 

10.1 Y-curate reserves the right to suspend, refuse, or terminate access to the facility where: 

• these Terms are breached; 

• insurance or qualifications are not maintained; 

• unsafe conduct occurs; or 

• behaviour presents a safety, reputational, operational, or security concern. 

10.2 No refunds will be provided where access is suspended or terminated due to breach of these Terms. 

11. Governing Law 

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
