By booking and using the Home Gym facilities at Y-curate (“Y-curate”, “we”, “our”, or “us”), you agree to the following Terms & Conditions. 

These Terms apply to all “Home Gym Solo”, “Home Gym Buddy”, and “Home Gym Trio” bookings. 

1. Eligibility & Acceptance of Risk

1.1 By booking and using Home Gym, you confirm that you are physically and medically fit to participate in exercise and strength training activities. 

1.2 You acknowledge that physical exercise, strength training, and the use of gym equipment involve inherent risks, including the risk of injury, serious harm, or death. 

1.3 You voluntarily participate in all activities at your own risk and accept full responsibility for your use of the facilities and equipment. 

1.4 Users under the influence of alcohol, illegal substances, or any condition that may impair safe judgement or physical ability must not use the facility. 

2. Bookings & Payments

2.1 Home Gym sessions must be booked in advance through the Y-curate online booking platform. 

2.2 Bookings are subject to availability and are confirmed only once payment has been received. 

2.3 Session packages (including 4, 8, or 12 session packages) must be used within the validity period stated at the time of purchase. 

2.4 Unused sessions that expire outside the applicable validity period are non-refundable and non-transferable. 

2.5 Bookings may be rescheduled up to 24 hours before the scheduled session start time. 

2.6 Cancellations, refunds, or transfers are not permitted within 24 hours of the booking start time. 

2.7 Y-curate reserves the right to amend, cancel, or refuse bookings where reasonably necessary for operational, maintenance, safety, or security reasons. 

3. Solo, Buddy & Trio Bookings

3.1 “Home Gym Solo” bookings permit access for one individual only. 

3.2 “Home Gym Buddy” bookings permit access for a maximum of two individuals. 

3.3 “Home Gym Trio” bookings permit access for a maximum of three individuals. 

3.4 No additional individuals may enter or use the facility beyond the booking type purchased. 

3.5 The person making the booking is responsible for ensuring that all accompanying guests comply with these Terms & Conditions and all gym rules. 

4. Access & Security

4.1 The Home Gym operates on a self-service basis and may be accessed without staff supervision. 

4.2 Access instructions and entry codes will be provided prior to the booking. 

4.3 Access codes are confidential and must not be shared, copied, distributed, or used by any unauthorised person. 

4.4 Unauthorised sharing of access credentials may result in immediate suspension or termination of access without refund. 

4.5 Users may access the premises only during their booked session time. 

4.6 Users must leave promptly at the end of their booking period. 

4.7 If you are the final user leaving the premises, you are responsible for ensuring the building is secured in accordance with the closing instructions provided. 

5. Use of Equipment & Facilities

5.1 All equipment must be used safely and only for its intended purpose. 

5.2 Users are responsible for exercising within their own physical limits and capabilities. 

5.3 Users acknowledge the additional risks associated with training alone. 

5.4 Any damaged, unsafe, or faulty equipment must not be used and should be reported immediately to Y-curate. 

5.5 Equipment, weights, mats, and accessories must be returned to their proper place after use. 

5.6 The facility must be left clean, tidy, and in substantially the same condition in which it was found. 

6. Health, Safety & Conduct

6.1 Users must behave responsibly and with consideration for neighbouring businesses, residents, and other users of the premises. 

6.2 Dangerous, reckless, abusive, or inappropriate behaviour is strictly prohibited. 

6.3 Smoking, vaping, illegal substances, and excessive alcohol consumption are prohibited within the premises. 

6.4 Users must comply with all safety instructions, signage, and emergency procedures communicated by Y-curate. 

6.5 In the event of an accident, injury, or incident, users must notify Y-curate as soon as reasonably possible. 

7. CCTV & Privacy

7.1 CCTV operates within parts of the premises for safety, security, and incident investigation purposes. 

7.2 By entering and using the facility, users acknowledge and consent to CCTV recording in accordance with applicable data protection laws and the Y-curate Privacy Policy. 

8. Damage & Liability

8.1 Users are responsible for any damage caused to the premises, equipment, or facilities by themselves or their guests. 

8.2 Any damage, breakage, or maintenance issue must be reported immediately to Y-curate. 

8.3 Y-curate reserves the right to recover reasonable costs associated with repair, replacement, additional cleaning, or security callouts resulting from misuse or breach of these Terms. 

8.4 Y-curate accepts no responsibility for: 

• loss, theft, or damage to personal belongings; 

• injuries arising from misuse of equipment; 

• interruptions caused by circumstances outside our reasonable control; or 

• unsupervised activities undertaken by users. 

8.5 Nothing in these Terms excludes or limits liability where such exclusion is not permitted by law. 

9. Termination & Refusal of Access

9.1 Y-curate reserves the right to suspend, refuse, or terminate access to the facility where these Terms & Conditions are breached or where behaviour presents a safety, security, or operational concern. 

9.2 No refunds will be provided where access is suspended or terminated due to breach of these Terms. 

10. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
